By using our site, we understand that you have read, understood and expressly accepted the terms and conditions by which we are governed, which are in accordance with our interpretation of the legislation in force. We also expect you to comply with all applicable laws and rules. The content of this site is fully protected by law and may not be used by third parties without the express consent of Clevercar.

The clevercar.pt website is operated by Gear Up Solutions Unipessoal, Lda., which acts as the controller for the personal data described in this policy. Clevercar is the brand under which we provide our services.

Services and Liability

Clevercar provides consulting and support services for vehicle imports. We are not a car dealership, nor do we resell vehicles. Our mission is to make the import process easier for our clients by handling the associated bureaucracy and logistics.

As such, Clevercar assumes no liability for the state or condition of imported vehicles. Our liability is limited to the correct execution of the contracted import services. Any matter relating to the condition, warranty or defects of the vehicle is the sole responsibility of the original seller or the manufacturer.

Personal Data

All personal data we request from you is strictly necessary to provide the various services you request from us. We comply with the legal framework in force regarding data protection, including the new GDPR (General Data Protection Regulation – Regulation EU 2016/679).

We do not sell your personal data, and the data you provide through our forms is not passed to third parties for their own commercial use. We share it only with the processors needed to deliver the service, listed below, and where the law requires it.

One exception deserves to be stated plainly: if you allow advertising cookies, identifiers tied to your device — not your name, email or phone number — are shared with Google for ad measurement and remarketing, as described under Cookies and similar technologies. That sharing depends entirely on your consent and can be withdrawn at any time.

The purposes for which we request personal data are the following:

  • Contact form: we collect your name, email, phone number and the message you write, so we can reply. Legal basis: consent, given through the checkbox on the form itself (Art. 6(1)(a) GDPR).
  • Quote request form: we collect your name, email, phone number, the link to the listing for the vehicle you want to import and your description of what you need, so we can prepare a quote. Legal basis: consent, given through the checkbox on the form itself, and pre-contractual steps taken at your request (Art. 6(1)(a) and (b) GDPR).
  • Engaging our services: if you go on to engage us, we process the data needed to perform the contract and to manage your import. Legal basis: performance of the contract (Art. 6(1)(b) GDPR).
  • Invoicing and payment: we issue an invoice for the services engaged and track its payment. Payments are made by SEPA bank transfer to the IBAN shown on the invoice; this site integrates no payment platform and collects no bank or card details. Any details your bank passes to us with the transfer reach us that way, not through the site. Legal basis: performance of the contract and compliance with legal and tax obligations (Art. 6(1)(b) and (c) GDPR).

Processors

We use service providers that process personal data on our behalf and only on our instructions:

  • ActivePieces: Receives and forwards the data submitted through our contact and quote forms, so your message reaches our team.
  • Netlify: Hosts this site and processes the technical access logs needed to operate and secure it.
  • Google and PostHog: As described under Cookies and similar technologies, and only with your consent.

Data retention: Personal data is kept only for as long as necessary to fulfill the purposes for which it was collected, or as required by law. Contact data is kept for a maximum period of 3 years after the last contact, unless you request its deletion. Invoices and other accounting records are kept for 10 years, as required by Portuguese tax law. For as long as that period runs, it takes precedence over a deletion request.

Your Rights Under the GDPR

In accordance with the General Data Protection Regulation (GDPR), you have the following rights regarding your personal data:

  • Right of access: You may request information about the personal data we process about you.
  • Right to rectification: You may request the correction of inaccurate or incomplete personal data.
  • Right to erasure: You may request the deletion of your personal data in certain circumstances.
  • Right to restriction: You may request the restriction of the processing of your personal data.
  • Right to data portability: You may request the transfer of your data to another data controller.
  • Right to object: You may object to the processing of your personal data in certain circumstances.
  • Right to withdraw consent: Where processing is based on consent, you may withdraw it at any time.

To exercise any of these rights, simply send us an email at info@clevercar.pt with your specific request.

We will respond within a maximum of 30 days as required by the GDPR. If your request is complex, we may extend this period by a further 60 days, informing you of the reasons for the extension.

If you are not satisfied with our response, you have the right to lodge a complaint with the Comissão Nacional de Proteção de Dados (CNPD), the Portuguese data protection authority.

Cookies and similar technologies

This site uses cookies and similar technologies. There are three categories, and only the first is used without your consent.

Essential Cookies

Strictly necessary cookies: Required for the site to work and cannot be switched off. They include session cookies, language preferences and security cookies.

Consent cookies: We store your cookie choice in your browser so we do not have to ask again on every visit. Legal basis: legitimate interest in honouring your decision (Art. 6(1)(f) GDPR).

Analytics Cookies (Optional)

These help us understand how the site is used so we can improve it.

  • Google Analytics 4: Measures visits, page views and traffic sources. The data is tied to a device identifier, not to your name. Retained for 14 months.
  • PostHog: Analyses on-site behaviour (clicks, pages visited) to improve the experience. Data is hosted in the European Union and retained for a maximum of 24 months.

Advertising Cookies (Optional)

These let us measure how well our ads work and show you relevant advertising on other sites.

  • Google Ads: Records whether you reached our site through an ad and later contacted us, so we can tell which ads work. It also enables remarketing: if you allow this category, identifiers tied to your device are shared with Google, which may show you Clevercar ads on other sites and apps.

Legal basis: The analytics and advertising categories depend on your explicit consent, given through the cookie banner (Art. 6(1)(a) GDPR). Until you consent, these technologies are blocked through Google Consent Mode and no analytics or advertising cookie is written to your device.

Tag management

We use Google Tag Manager to manage the services above. It does not collect data about you by itself, but it is what loads Google Analytics and Google Ads, respecting the categories you allowed. See Google's privacy policy for details.

International transfers

Google Analytics and Google Ads are provided by Google, which may process data outside the European Economic Area, including in the United States. Those transfers rely on the Standard Contractual Clauses approved by the European Commission and on the EU–US Data Privacy Framework. PostHog data is hosted in the European Union.

Cookie Management

You can change or withdraw your consent at any time, as easily as you gave it. Withdrawing consent does not affect the lawfulness of processing carried out before the withdrawal.

Alternatively, you can configure your browser to refuse some or all cookies, and to delete those already stored.
